Jose Padilla and the Constitution


The unconstitutional detention of Jose Padilla sets a very dangerous precedent for our democracy. If we allow the executive branch to arrest an American citizen indefinitely without recourse and without trial, what's to prevent some future president from using this power politically?

Now Phil Carter has an excellent analysis of both the problems with the Jose Padilla case, and the historical reasons why we have these constitutional protections.
